Terms of Service

Welcome to Sweet Crush Gaming Ltd. These Terms of Service ("Terms") govern your access to and use of our website sweetcrushzone.com (the "Site") and our mobile game Sweet Crush: Match 3 Game (the "Game"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or playing the Game, or by visiting our Site, you accept and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

We reserve the right to modify these Terms at any time. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

2. Use License

Sweet Crush Gaming Ltd. grants you a personal, non-exclusive, non-transferable, limited license to download, install, and use the Game for your personal, non-commercial entertainment purposes, subject to these Terms.

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the Game
• Remove any copyright or proprietary notices from the Game or Site
• Use the Game or Site for any commercial purpose without our express written consent
• Use any automated system (bots, scripts, etc.) to access or play the Game
• Attempt to hack, interfere with, or disrupt the Game's servers or infrastructure
• Exploit bugs or glitches for personal gain
• Harass, abuse, or harm other players
• Create multiple accounts to circumvent game mechanics

3. In-Game Currency: Bonus Score (BS)

Sweet Crush offers an optional in-game virtual currency called "Bonus Score" (BS). Important terms regarding BS:

• No Real-World Value: BS has no real-world monetary value and cannot be exchanged for cash, goods, or services outside the Game.
• No Refunds: All purchases of BS are final. We do not offer refunds except where required by law.
• Welcome Bonus: New players receive 100 BS as a welcome bonus at no charge.
• Earned BS: You may earn additional BS through gameplay achievements and events.
• Optional Purchases: You may optionally purchase additional BS using real money through authorized payment platforms (Google Play).
• Game Balance: All levels are designed to be completable without purchasing BS. BS purchases are purely for convenience and customization.
• Account Termination: If your account is terminated for violating these Terms, you forfeit all BS and any associated purchases.

4. User Accounts and Responsibilities

While the Game does not currently require account creation, future features may include account functionality. If accounts become available:

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate information when creating an account
• You must immediately notify us of any unauthorized use of your account

5. Intellectual Property Rights

All content in the Game and on the Site, including but not limited to graphics, logos, text, music, sound effects, code, and game mechanics, is the property of Sweet Crush Gaming Ltd. or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You acknowledge that you do not acquire any ownership rights by using our services. The Sweet Crush name, logo, and all related names and logos are trademarks of Sweet Crush Gaming Ltd.

6. Prohibited Uses

You may not use our services:

• In any way that violates applicable local, national, or international law
• To transmit or procure the sending of any advertising or promotional material without our consent
• To impersonate or attempt to impersonate Sweet Crush Gaming Ltd., our employees, or other users
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Game
• To introduce viruses, malware, or other malicious code

7. User-Generated Content

If the Game allows you to submit content (such as usernames, profile pictures, or messages):

• You retain ownership of content you submit
• You grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Game
• You represent that you have the right to submit such content
• Content must not be offensive, illegal, or violate third-party rights

8. Privacy and Data Collection

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection and use practices.

9. Disclaimers and Limitation of Liability

The Game and Site are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Game will be uninterrupted, error-free, or secure
• Defects will be corrected
• The Game or servers are free of viruses or harmful components
• Results obtained from using the Game will be accurate or reliable

To the fullest extent permitted by law, Sweet Crush Gaming Ltd. shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages arising from your use or inability to use the Game
• Unauthorized access to or alteration of your data

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

10. Updates and Modifications

We reserve the right to:

• Update, modify, or discontinue the Game (or any part thereof) at any time with or without notice
• Change game features, BS pricing, or availability
• Perform scheduled or emergency maintenance

We are not liable to you or any third party for any modification, suspension, or discontinuance of the Game.

11. Termination

We may terminate or suspend your access to the Game immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent activity or unauthorized use
• Requests by law enforcement or government agencies
• Unexpected technical issues

Upon termination, your right to use the Game ceases immediately. You may also terminate your use by deleting the Game from your device.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Game shall be resolved through binding arbitration in Estonia, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.

13. Indemnification

You agree to indemnify, defend, and hold harmless Sweet Crush Gaming Ltd., its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Game or Site
• Your violation of these Terms
• Your violation of any third-party rights

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sweet Crush Gaming Ltd. regarding the Game and supersede all prior or contemporaneous understandings.
